Culpable Homicide Part 1

Culpable = blameworthy

Homicide is latin word where homa - man and cide - i cut . Killing of a human being by another human being is homicide. killing means murder and has been defined under section 300 of Indian Penal Code 1860.
In this first part we are going to see when culpable homicide is murder ?

Offence against human life is murder and culpable homicide is murder in the following cases :

1 . Intention to cause death is proved

THE person must have the intent to cause harm in such a way that death is the only resort that needs to be sought.

2 . Act of the person

Along with the intention of the person, he knows that the particular act will result in death only. eg. shooting the person or poisoning his food will result in death.

3. Sufficient force

If sufficient force is applied to cause death, it means that when a person applies force in such a way that will result in death then this constitutes a culpable homicide amounting to murder eg. pushing a person off a cliff, applying force on his neck will result in death .

4 . Dangerous weapon

When an offender has the knowledge that he has used a dangerous weapon which is likely to cause bodily harm or injury and that which causes death is culpable homicide amounting to murder . eg. killing a person with a sword , knife, shooting him with a gun are all probable dangerous weapons that will cause death .
