  न्यायमूर्ति पी. एन. भगवती ने यह भी कहा है कि: अब इस बात को सुस्थापित माना जा सकता है कि जहां किसी व्यक्ति अथवा एक निश्चित व्यक्ति - समूह को उसके संवैधानिक या कानूनी अधिकार के उल्लंघन के कारण किसी विधिक अन्याय अथवा विधिक क्षति का शिकार होना पड़ा है या किसी संवैधानिक अथवा कानूनी उपबंध के उल्लंघन से अथवा कानूनी प्राधिकार के बिना उस पर कोई भार आरोपित किया गया है या ऐसे विधिक अन्याय या विधिक क्षति या अवैध भार की कोई आशंका है और ऐसा व्यक्ति या निश्चित व्यक्ति - समूह निर्धनता, असहायावस्था, निर्योग्यता या सामाजिक अथवा आर्थिक दृष्टि से अपनी अलाभकर स्थिति के कारण राहत के लिए न्यायालय तक पहुंचने में असमर्थ है तो जनता का कोई सदस्य अनुच्छेद 226 के अधीन उच्च न्यायालय में उचित निदेश, आदेश या रिट जारी करने के लिए आवेदन प्रस्तुत कर सकता है और यदि किसी व्यक्ति या निश्चित व्यक्ति - समूह के किसी मूल अधिकार का भंग हुआ है तो उसके साथ हुए विधिक अन्याय या विधिक क्षति का न्यायिक उपचार पाने के लिए संविधान के अनुच्छेद 32 के अधीन उच्चतम न्यायालय में आवेदन किया जा सकता है ।
