"Talaq Talaq Talaq! "
The Passage of Muslim Women (Protection of Rights on Marriage) Act, 2019 implemented from 19th September, 2018 is a defining moment that calls for celebration.
This law criminalizes the extra-judicial talaq of Talaq-e-biddat also known as Triple Talaq which was unilateral, irrevocable, one time triple pronouncement of talaq available to Muslim Men in India.
This law was a practice followed by Sunni Muslims but more than 22 countries includung Pakistan, Afghanistan, Iran, Saudi Arabia, Bangladesh and Malaysia have abolished TRIPLE TALAQ.
The Women's activist rights have taken the court's decision as a historic victory.
The Muslim Women (Protection of Rights on Marriage) Act, 2019 declares that any pronouncement of Talaq by Muslim husband upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal, and such husband shall be punished with imprisonment for a term which may extend to 3 years and shall also liable to fine.
This decision us a great success for Muslim Women. For many decades, they have to live with the threat of an immediate divorce.
Prime Minister lauded the Parliament for putting ab end to the "archaic and mediaeval practice" and correcting a "historical wrong."
It takes one pleasant gesture to make someone's day and only three words to destroy someone's life i.e. - "TALAQ TALAQ TALAQ. "
The Indian Government led by Hindu Nationalists Bharatiya Janata Party (BJP), endorsed the practice. The Prime Minister Narendra Modi raised the issue many times.
There divorce broke their marriage, but even more than that it broke the hearts of the children who were not at faul, but still the innocent souls had to undergo severe mental trauma for the rest of their lives.
The Supreme Court's judgement against instant Triple Talaq is a welcome measure. Triple Talaq in one go does not have religious sanction and is patently unjust and amti-women. More than 20 Muslim Countries have banned it and it has no place in Seculae India.
Any pronouncement of Talaq by Muslim husband upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal.
Any Muslim husband shall be punished with imprisonment for a term which may extend to three years and shall also liable to fine.
Finally the Triple Talaq judgement came in favour.
