Does Article 370 Need To Be Abolished?

One of the biggest promises made by BJP during elections was to abolish article 370 if they return into power. BJP has even mentioned it in its election manifesto. Many Big leaders including prime minister Narendra Modi, Amit shah raised this issue during their rallies.Now when Bhartiya Janta Party returned in power with much stronger mandate than the previous one, speculations and talks have been started on abolishing article 370 and 35A.

What is article 370.

Article 370 gives special status to Jammu and Kashmir. According to the Indian constitution it provides temporary status to the Jammu and Kashmir granting it a special autonomy. All the provisions of the constitution which are applicable to other states are not applicable to Jammu and Kashmir. For Example, till 1965 there had been a sardare-riyasat instead of a governor.According to this article expect from defense, foreign affairs, finance, parliament needs a state government consent for applying all other rules in the state. Thus, state has a separate set of laws. No other person apart from the citizens of Jammu and Kashmir can purchase land there. Emergency can be declared by central government only in case of war or external aggressions.Article 370 was given to the state of J&K in order to safeguard their right and enhance their lifestyle but it is now highly misused to spread terrorism, and anti-national activities.

Article 370 is also violating the basic rights of Indian citizens according to the constitution of India, that any Citizen can live, own property in any part of India. Just because people outside J&K cannot buy land there are no major companies or industries established and because of that people of J&K are facing problems of Unemployment.Government needs to abolish article 370 and 35A as this time they have the majority in parliament. The procedure which needs to be followed for this is- A bill stating this needs to be passed in Lok Sabha and Rajya Sabha and then needs an approval from the president.
