From Nariman To Rohatgi, Top Legal Eagles Steps Into Alok Verma Plea.

Supreme Court is hearing a plea filed by Alok Verma asking how the power can be deprived with government interference and also pushing him to forced leave. In the Apex Court the legal luminaries have been roped into flex of the argumentative muscle.

Verma's Claim :-

There is a violation of his fundamental right at the agency by the government stripping him of his duties. And also by appointing an interim chief in the place of him his fundamental right is violated. The Central Bureau of Investigation (CBI) should be allowed “to function completely, independently and autonomously” Verma emphasised in the petition. He also said “there are bound to be occasions when certain investigations into high functionaries robot take the direction that may be desirable to the government”. However in his petition it is stated that special Director of CBI is posing hurdles at the CBI where recently the special direction is in a different view even though all functionaries within the CBI have agreed on a certain course of action. As an institution the CBI should be away from government influence as the present situation is an example where there is a stripping of powers from Alok Verma, so there is a need of separate independence than DoPT (Department of Personnel and Training) as the functioning of the CBI is being harmed.

So, in order Alok Verma filed a writ petition under Article :- 32 of the Constitution of India.

On behalf of Alok Verma a senior Advocate Fali S Narman who is a eminent jurist and Sanjay Hegde are representing on Petitioner side Alok Verma. And on behalf of Rakesh Asthana special Director of CBI former Attorney General of India and also Senior lawyer Mukul Rohatgi is representing.

HoweverMukul Rohatgi also countered a Public Interest Litigation (PIL) filed by common cause. Where the common cause PIL was brought or moved by Advocate Prashant Bhushan. The PIL filed by Advocate Prashant Bhushan seeks under the surveillance of top court a probe should be made into the corruption allegations against high level CBI officials.

The PIL also seeks from the post CBI special director Rakesh Asthana should be removed keeping in mind of the recent FIR allegation of acceptance of bribe to slow down investigation against Moin Qureshi which is registered against him. On behalf of Chief Vigilance Commission (CVC) and Government of India K K Venu Gopal (Attorney General of India) and Thushar Mehta (Solicitor General of India) would be arguing. Against the FIR lodged, Rakesh Asthana has approached the Delhi Court.
