Marriage is viewed as a sacrament in Hinduism with the wife being viewed as under the possession of the husband. A wife is considered chattel of the husband and a man cannot commit a crime against his own property. Marital rape is one of the under-reported violent crimes because it is socially tolerated. Some abused women are afraid to report the violence because they rely financially on their husbands for their upkeep and children's maintenance . Their own family members would not accept them if they leave their husband. Section 375 of the Indian penal code (IPC) considers the forced sex in marriages as a crime only when the wife is below age 15. Thus, marital rape is not a criminal offence under the IPC. Marital rape victims have to take recourse to the protection of women from Domestic Violence Act 2005 (PWDVA).
